Camp Lejeune cancer lawsuit

Camp Lejeune Water Cancer Victims Continue To Wait And Wait And Wait (Part Two)

U.S. Marine Corps Master Sgt. Jerry Ensminger has been a vocal advocate and has devoted a significant portion of his life trying to get Justice for his family and others

Sunday, January 22, 2023 - As incredible as it may sound, what once were feelings or euphoria at having the Camp Lejeune Justice Act passed enabling individuals that were injured by drinking contaminated water at the base the ability to receive lump-sum monetary compensation, has turned into frustration and for some despair. Over 15,000 individual Camp Lejeune Justice Act claims have been filed and most have stalled under the avalanche of paperwork and military procedures. Some veterans have been notified that their claims have been rejected for a second or third time and are frustrated that there are no answers. For example, retired U.S. Marine Corps, Master Sgt. Jerry Ensminger has fought with several others for decades for the military to address the multitude of illnesses that were caused by drinking contaminated Camp Lejeune water. Ensminger was among the thousands of others who filed a Camp Lejeune water lawsuit before first simply filling out an administrative claims form with the JAG. His lawsuit was rejected and now he has to start the process again fresh. Ensminger is angry that the military has been putting off him and thousands of others for years. " Ensminger, who served for 25 years in the Marine Corps, slammed the military and the Department of Justice (DOJ) for doing "everything in their power to kill" legislation that took decades to pass.," According to The Hill.com. Ensminger has been a vocal advocate and has devoted a significant portion of his life trying to get Justice for his family and others.

Ensminger's case is unique in that it opens the door for thousands of wrongful death lawsuits from the parents who lived on Camp Lejeune during their pregnancy and gave birth to a child that was stillborn, deformed, or whose genetics were so altered that the child developed cancer at an early age. Ensminger's lobbying was instrumental in getting childhood leukemia designated as being an illness on the official list of diseases presumed to have been caused by drinking Camp Lejeune water. Ensminger and others were initially ecstatic at the passage of the CLJA but have now grown frustrated at the military administrative delaying tactics. Ensminger's daughter, Janey, died from leukemia at the age of nine which he believed was caused by his wife drinking contaminated Camp Lejeune water while pregnant. Ensminger's frustration at the military's delay is supported by the debacle where thousands of Camp Lejeune water cancer claims were rejected by error. The Military Times wrote in an article titled, " The VA botched thousands of Camp Lejeune water contamination cases." In the article the investigators found, " Veterans Affairs processors in recent years mishandled more than one-third of all disability claims related to water contamination issues at Camp Lejeune in North Carolina, potentially cheating as many as 21,000 veterans out of financial compensation." This case alone is worthy of outrage, not to mention as many as one million people may have drank enough contaminated Camp Lejeune water to have a case to sue the government for their disease.
